These Terms of Use ("Terms") govern your access to and use of the Orbitshala platform, including our website, apps, content, test-taking tools, analytics, and AI-assisted insights ("Services"). By using the Services, you agree to these Terms.

1) Definitions

  • “Orbitshala”, “we”, “us” means the operator of the Services.
  • “You” means the user of the Services (student, parent/guardian, teacher, admin, etc.).
  • “Myna” means our automated/AI-assisted analytics and recommendations feature.
  • “Content” includes questions, solutions, explanations, tests, analytics reports, UI, and branding.

2) Eligibility and minor users

Orbitshala is designed for students and may be used by minors. If you are under the age of majority applicable to you, you represent that your parent/guardian has reviewed these Terms and agrees to them on your behalf (where required by law). We may require a guardian email or additional verification for safety or account requests.

You must provide accurate information and keep it updated. You may not use the Services if you are prohibited from doing so under applicable law.

3) The Services

Orbitshala provides mock tests, practice tests, time tracking (including dual timers), progress tracking, rankings/benchmarks (where enabled), and analytics including Myna insights.

We may add, remove, or modify features from time to time. Some features may have usage limits, including slot reservations, daily limits, fair-use limits, and capacity safeguards.

4) Accounts and security

  • You’re responsible for maintaining the confidentiality of your login credentials and devices.
  • You must promptly notify us of unauthorized use of your account.
  • You may not share accounts, evade limits, or access accounts that aren’t yours.

5) Acceptable use and integrity

  • No cheating, impersonation, harassment, self-harm promotion, or abuse in any community features.
  • No scraping, reverse engineering, automated extraction, or interference with platform performance.
  • No uploading unlawful, offensive, harmful, or infringing content.
  • No attempts to manipulate timers, results, ranking/percentiles, or analytics outputs.

6) Slot reservations and fair access

To manage traffic and ensure reliability, Orbitshala may require slot reservations for certain activities. Where applicable, slot rules (capacity, time windows, limits per user/day, cancellation windows) may change. We may cancel or adjust reservations to address maintenance, system health, fairness, or abuse.

7) Content, IP, and permitted use

The Services and Content are owned by Orbitshala or its licensors and are protected by intellectual property laws. You may use the Services for personal, non-commercial learning.

You may not copy, sell, redistribute, publish, or create derivative works from Orbitshala Content without written permission, except where allowed by law.

8) User submissions and feedback

If you submit content (e.g., discussion posts, feedback, reports, suggestions), you grant Orbitshala a non-exclusive, worldwide, royalty-free license to host, reproduce, modify, and use it to operate, secure, and improve the Services. You represent that you have the rights needed to submit the content.

9) Paid features (future), billing and refunds

At launch, Orbitshala may be free. If we introduce paid subscriptions or add-ons, the checkout page will show the price, taxes (if any), and terms. Refunds, if offered, will be governed by the Refund & Cancellation Policy and any terms shown at checkout.

10) Disclaimers

  • Orbitshala is an educational support tool. We do not guarantee any rank, score, selection, admission, or exam outcome.
  • Myna insights are automated and may be incomplete, inaccurate, or not suited to every learner. Use them as guidance.
  • The Services are provided on an “as is” and “as available” basis to the maximum extent permitted by law.

11) Limitation of liability

To the maximum extent permitted by law, Orbitshala will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, goodwill, or opportunities.

To the maximum extent permitted by law, Orbitshala’s total liability for all claims relating to the Services will not exceed (a) the amount you paid to Orbitshala for the Services in the 3 months before the event giving rise to the claim, or (b) INR 1,000, whichever is higher.

12) Suspension, termination, and deletion

We may restrict, suspend, or terminate access if you violate these Terms, create risk to the platform or other users, or if required by law. You may request deletion of your account as described in our Privacy Policy.

13) Dispute resolution, arbitration, and governing law

If a dispute arises, you agree to first contact us and attempt informal resolution.

If the dispute isn’t resolved, to the extent permitted by law, it will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration will be Bengaluru, Karnataka, India, the proceedings will be in English, and a sole arbitrator will be appointed.

These Terms are governed by the laws of India. Subject to arbitration, courts at Bengaluru, Karnataka shall have exclusive jurisdiction.

14) Changes to these Terms

We may update these Terms from time to time. If changes are material, we’ll take reasonable steps to notify you (for example, by posting an update on this page). Continued use of the Services after an update means you accept the updated Terms.
